Terms & Conditions

These Terms and Conditions ("Terms") govern your use of the Monsunai website at monssuen.pro and your participation in any of our yacht tour services. By accessing this website or booking a voyage with Monsunai, you agree to be bound by these Terms. Please read them carefully before submitting an enquiry or confirming a booking.

By submitting an enquiry through our website or confirming a booking, you confirm that you are at least 18 years of age, have the legal capacity to enter into this agreement, and agree to these Terms in full. Participation by guests under 18 requires the presence and consent of a parent or legal guardian.

3. Service Description

Monsunai offers yacht tour experiences departing from Port Klang, Selangor, Malaysia. The three voyage formats available are described in detail on our Solutions page. All voyages are subject to weather and sea conditions. Route details are adapted by the captain on the day of departure based on prevailing conditions.

Monsunai reserves the right to modify voyage itineraries, departure times, or included activities where necessary for safety, operational, or environmental reasons.

4. Bookings and Payment

4.1 Booking Confirmation

A booking is confirmed only when Monsunai has issued written confirmation and a deposit has been received. Verbal or email enquiries alone do not constitute a confirmed booking.

4.2 Deposit and Balance

A deposit of 50% of the voyage price is required to confirm a booking. The remaining balance is due no later than 7 days before the departure date. Full payment terms will be communicated at the time of booking confirmation.

4.3 Pricing

All prices are quoted in Malaysian Ringgit (MYR) and are per voyage (not per person), unless otherwise stated in writing. Prices include the items specified in the voyage description and exclude transportation to and from Port Klang, personal insurance, and any purchases made onshore during stops.

5. Cancellation and Rescheduling

If Monsunai cancels a voyage due to unsafe weather or sea conditions, mechanical failure, or other circumstances beyond our control, guests will be offered a rescheduled departure or a full refund of amounts paid. Monsunai is not liable for travel, accommodation, or other costs incurred by guests as a result of such cancellation.

5.3 Rescheduling

Guests may request to reschedule a booking at no additional charge if notice is given more than 14 days before departure, subject to availability. Reschedule requests made within 14 days of departure are subject to a rescheduling fee, which will be communicated at the time of request.

Monsunai reserves the right to refuse or remove a guest from a voyage if their behaviour poses a risk to safety or the wellbeing of others. No refund will be issued in such cases.

7. Health and Safety

Participation in all voyages involves exposure to maritime conditions, including vessel motion, sun exposure, and variable weather. Guests participate at their own risk. Monsunai carries marine insurance covering the vessel and passenger liability; however, guests are strongly encouraged to arrange their own personal travel insurance.

All crew members hold current maritime qualifications. Safety equipment is maintained in accordance with Malaysian Maritime Enforcement Agency standards and inspected before every departure.

8. Intellectual Property

All content on the Monsunai website, including text, photographs, and design elements, is the property of Monsunai or its content providers and is protected by Malaysian intellectual property law. You may not reproduce, distribute, or use this content for commercial purposes without prior written consent.

9. Disclaimers

Monsunai's services are provided in good faith based on reasonable professional judgement. We do not make representations about specific sea conditions, wildlife sightings, or outcomes on any particular voyage. Weather, tides, and natural conditions are outside our control.

This website is provided "as is." We do not warrant that the website will be uninterrupted, error-free, or free from viruses.

10. Limitation of Liability

To the maximum extent permitted by Malaysian law, Monsunai's liability to any guest is limited to the price paid for the voyage in question. Monsunai is not liable for indirect, consequential, or incidental losses, including loss of earnings, travel costs, or accommodation expenses, arising from voyage cancellation or modification.

Nothing in these Terms excludes liability for death or personal injury arising from Monsunai's negligence.

11. Indemnification

You agree to indemnify and hold harmless Monsunai, its crew, and its officers from any claims, damages, or expenses arising from your breach of these Terms, your failure to follow safety instructions, or any act or omission on your part during a voyage.

12. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of Malaysia. Any dispute arising from these Terms or the provision of our services shall be subject to the exclusive jurisdiction of the courts of Malaysia.

In the event of a dispute, we encourage you to contact us directly at [email protected] in the first instance. We will make reasonable efforts to resolve the matter informally within 30 days.

13. Modifications to These Terms

Monsunai may update these Terms from time to time. The current version will always be available on this page with a revised date. Continued use of our website or services following an update constitutes acceptance of the revised Terms.
